Terms & Conditions

Hi! We don’t like surprises when buying stuff online, and we’re sure you don’t either... so please read this page carefully and if you have any questions, send an email to hello@theotherm.com or you can call our support line only for SHIPMENT questions on +44 (0)20 8133 1519 (standard call charges apply).
All of our products are sold by The Other M Limited, an English company (no. 09375742) and our address is 79 College Road, Harrow-on-the-Hill, Middlesex, HA1 1BD, UK. By using our site and ordering products from us, you confirm that you have read and accept these terms of sale and our privacy and cookie policy and our returns policy (collectively our ‘Terms’). We may make changes to our Terms from time to time and the current Terms will apply with each new order you place.

1. Our products, price and payments

Our products are all subject to availability and we’ll do our best to keep accurate stock/availability levels reflected on our site. The images on our site are for illustrative purposes only and since everyone browses the web using a different device, we can’t guarantee that what you see on your screen is exactly what you will get if you place an order. We may also make small changes and improvements to our designs in between our photo shoots, so please bear this in mind if the product you receive does not look exactly the same as what you see on the site (they will still be awesome).

For our visitors located in the UK and outside the EU, prices are listed in pounds sterling. For our EU based visitors, prices are listed in euros. VAT is included in all prices except where indicated otherwise (prices for "Rest of the World" visitors are without VAT). Price may change from time to time, but any changes won’t affect orders which we have already accepted and for which you have received a confirmation email.

Payment is only accepted by credit (Visa, Mastercard) and debit (International Maestro, International Visa Electron, UK Visa Electron, UK Debit MasterCard, UK Debit Visa, UK Maestro) and PayPal. In order to process your order we’ll need to share your payment details with third party service providers, which will be done in accordance with our privacy policy.

2. The contract

When you place an order, you will be making an offer to us to buy the product/s in your order. We’ll send you an immediate email acknowledging the order you’ve made, although this does not mean your order has been accepted.
The contract between us will only be formed once we have successfully taken payment, after which we’ll send you another email confirming that your order has been accepted and your expected delivery date. Once we have taken full payment, you will own the products and they will be at your risk as soon as they are dispatched from our warehouse.

3. Delivery

We offer free delivery within the EU (EU VAT zone). For deliveries outside the EU, your shipping cost will be calculated at checkout. Deliveries outside the EU may be subject to local import taxes or levies for which you will be solely responsible and we cannot estimate in advance. Possibility for Express shipment are given both for EU and non EU customers with an extra charge calculated at check-out.
We’ll try to get your stuff to you as soon as possible, but since our items are handcrafted this may take some time if the products you have ordered are out of stock. We’ll inform you of availability and estimated delivery throughout the checkout process and in your order confirmation email. If something you’ve ordered becomes unavailable, we will let you know and issue you with a refund as soon as we can.
We’ll let you know when your order has been dispatched from our warehouse and when you can expect delivery, although these will only be estimates and not guaranteed delivery times, so please do not rely on them.

4. Your rights of cancellation and other statutory rights

As a consumer you have a legal right to cancel our contract for any reason within 14 days from the day on which you (or a third party indicated by you, e.g. if you’re buying a gift for someone) receives the goods purchased. If your order is delivered in multiple shipments, you will have 14 days from the day the last shipment is received. These rights of cancellation do not apply to any products which are unsuitable for return due to health protection or hygienic reasons or if they have been made to your specifications or are personalised.
If you want to cancel your order, please let us know. You can submit a request to do this through the returns section of our site, or by contacting us by email or telephone. Once we accept your return, you will have then to ship it back to us making sure it arrives in good conditions and it is perfectly protected. Returns postal costs will be taken in charge by the customer. We will make refunds back to the same card used to place the order within 14 days of receiving the products back at our warehouse. Please take care of any goods you wish to return, as we may adjust the refunded amount if the value of the products is reduced due to poor handling.

5. Our liability

Our products are of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied. We do not offer any further guarantees or warranties in relation to our products. We will not be liable for any direct or indirect loss or damage that you might suffer as a result of our breach of our Terms, but we do not exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, any breach of the terms implied by the Sale of Goods Act 1979, or for any defective products under the Consumer Protection Act 1987. Any loss you do suffer under our Terms for which liability has not been excluded is limited to the purchase price of the relevant order.

6. Our intellectual property

You acknowledge that all intellectual property contained in this site or any other promotional material and in the designs of the products is owned by us, and that by accessing this site or purchasing our products you must not copy or attempt to copy any of it.

7. General

Any contract created is between you and us. No other person has any rights to enforce any of its terms. Any failure by us to insist upon or enforce any provision of our Terms shall not be construed as a waiver of any of our rights. If any one of our Terms is declared invalid by a court, this will not affect the validity of the remaining terms. Our Terms are governed by English law and you agree to submit to the exclusive jurisdiction of the English courts in the event of any dispute.
